Introduction
CA2 is the court appointed Claims Administrator in the Sun Life / MetLife Universal Life Insurance Class Action.
The class action alleges improper administration of certain universal life insurance policies that were marketed and sold by Met Life from 1987 through to 1998. The policies are now administered by Sun Life. The proposed settlement provides for direct monetary compensation for certain members of the class and future policy benefits to currently policyholders.
A proposed $213.5 million settlement has bee reached. Under the proposed settlement, direct monetary compensation will be provided to certain current and former Flexiplus policyholders for a portion of past Cost of Insurance (“COI”) and Administrative Fee increases. Direct monetary compensation will also be provided to certain current and former Universal Plus policyholders for a portion of the COI charges paid in excess of the “Maximum Premium” amounts set out in their policies. The proposed Settlement also provides COI rate and administrative fee freezes for current Flexiplus policyholders, and a cap on future COI charges for current Universal Plus policyholders. OptiMet policyholders will not receive benefits under the proposed Settlement. The proposed Settlement includes payment of administration expenses, and Class Counsel will apply to the Court for approval of certain legal fees and disbursements to be paid out of that sum.
The national subclasses certified by the Court are:
- The “Universal Plus Class” is defined as persons who owned or own a Universal Plus policy sold by MetLife in Canada during the period 1987 through 1998, including any successor owners of the policy.
